The EU industrial hemp definition

Under Regulation (EU) 2021/2115, industrial hemp is Cannabis sativa L. with THC not exceeding 0.3% (raised from 0.2%, effective 1 January 2022). Hemp grown under this rule is an approved agricultural crop, and the flower and leaves are traded in most member states.

The Novel Food issue

CBD intended for food or food supplements falls under the EU Novel Food Regulation. CBD extracts were classified as novel foods, meaning they generally require authorisation before lawful sale as food or supplements. Some member states enforce this strictly; others tolerate CBD sales under national rules. Smokable hemp flower is sometimes treated separately from food, but classification varies by country.
